DRAFT Trading in Public Places Policy

The Shire of Denmark is seeking community feedback on its Draft Trading in Public Places Policy. The draft policy proposes a framework for businesses and individuals wishing to trade on public land, while ensuring public places remain safe, accessible, well managed and enjoyable for the community.

The draft policy introduces a risk-based licensing approach and distinguishes between fixed, occasional and low-impact trading. It also addresses alfresco dining and trading adjoining an established business, designated trading sites, application processes, fees, site care and transition arrangements.

Key features of the draft policy include:

• a two-yearly Expression of Interest process for fixed trading sites;
• a streamlined, year-round application process for occasional trading;
• no licence requirement for low-impact activities involving 10 or fewer people at any one time, where appropriate insurance is in place;
• no licence requirement for eligible alfresco dining or trading immediately adjoining a business, provided a clear and unobstructed pedestrian path of at least 2.0metres is maintained;
• designated fixed and occasional trading locations across the Shire; and
• requirements to protect public safety, access, amenity, the environment and nearby established businesses.

Public consultation is open until close of business on 16^th October 2026.
