On March 18, 2026, Peter Phan was convicted by a jury of the first-degree murder of Andy Van. The jury also found true a special circumstance that the murder was intentional and perpetrated by means of discharging a firearm from a motor vehicle. An allegation that Phan personally used a firearm causing death was also found true.
On October 27, 2022, the Sacramento Sheriff's Office received a ShotSpotter activation on Martin Luther King, Jr. Boulevard. A 911 call also came in reporting that an Acura crashed into a fence near 48th Avenue. Andy Van was driving that Acura when he was shot in the head. He later died at the hospital. Surveillance footage showed the victim's Acura was being chased by a Mercedes. Just before the victim's vehicle crashed, an object that appeared to be a firearm was extended from the driver's window of the Mercedes. The Mercedes plate was captured on video and showed it was registered to Peter Phan. Further investigation revealed that Phan was in the area of the murder during the same time as the shooting. It was also found that the victim had previously been in an altercation with one of Phan's associates.
An allegation that Phan has a prior strike for shooting at an inhabited building will be determined at the sentencing hearing.
Phan faces a maximum sentence of life in prison without the possibility of parole. Sentencing is set for June 12, 2026, at 9:00 a.m. in Department 18 before the Honorable Carlton Davis.
