It's now official. Collective bargaining agreements under new rules

To make it easier to conclude and register collective agreements, as well as to streamline the regulations governing them, the Ministry of Labour has prepared a draft that addresses the most important demands that social partners have been raising for years. On 27 November 2025, the President of Poland signed the Act.

Collective bargaining agreements are a form of arrangement concluded between an employer and employees represented by trade unions. Such agreements may set employment conditions that differ from those laid down in labour legislation - provided that they are more favourable to employees. These may include, for example, additional days of leave or annual pay increases.

On 27 November 2025, the President of the Republic of Poland signed the Act on Collective Bargaining Agreements and Collective Arrangements.

Collective bargaining agreements under new rules

The most important solutions found in the Act:

  • A company-level or multi-employer collective bargaining agreement may (CBA) be concluded in order to regulate matters that are not governed by mandatory labour law provisions. The so-called favourability principle is maintained, meaning that arrangements negotiated in a CBA cannot be less favourable to employees than statutory labour law provisions.
  • A CBA may regulate solutions that facilitate work-life balance, issues related to the use of new technologies (such as artificial intelligence) in the workplace, gender equality measures, anti-mobbing (anti-harassment) procedures, and measures to prevent psychosocial risks (such as stress or burnout).
  • Instead of registering CBAs, the Act introduces their electronic record-keeping - collective bargaining agreements and collective arrangements must be submitted to the National Register of Collective Bargaining Agreements exclusively in electronic form.
  • It will be possible to use the assistance of a mediator at the negotiation stage.
  • The duration of a CBA becomes more flexible - negotiating parties may conclude a CBA for a fixed term, with the possibility of extending its period of validity. It will also be possible to conclude a CBA for an indefinite term.
  • Multi-employer CBAs may be concluded by at least two employers, meaning that it will no longer be necessary for such agreements to be concluded by an employers' organisation.

When will the law come into force?

The new regulations will come into force 14 days after publication in the Journal of Laws.
