[SUPREME] Franklin T. Wike, et al. v. Grandview Solar Project, LLC, Town of Grandview, Indiana Board of Zoning Appeals, Town of Grandview, Indiana Town Council, and Town of[...]

In 2019, Grandview Solar received a special exception from Grandview's Board of Zoning Appeals (BZA) to build a solar farm. Three years later, Grandview Solar requested a permit to begin construction, which the town council and BZA denied. Grandview Solar and the Town settled the dispute, but several property owners sued separately, arguing Grandview Solar's 2019 special exception was void ab initio. The Spencer Circuit Court granted summary judgment for Grandview Solar and the Town, but the Court of Appeals reversed. Wike v. Grandview Solar Project, LLC, No. 24A-PL-1867 (Ind. Ct. App. Jan. 30, 2025), trans. pending. Grandview Solar and the Town have petitioned the Indiana Supreme Court to accept jurisdiction over the appeal.
