Hagåtña, Guam - The goal of the Freedom of Information Act (FOIA) is to hold government officials accountable by requiring transparency as a check against corruption and ensuring an informed citizenry. These goals are especially important when the agency being questioned claims to be the "watchdog" of our Government. If not adequately monitored, this agency can easily abuse the power of its office.
In this spirit, the Office of the Governor has submitted a FOIA request to the Office of the Attorney General (OAG), currently led by Attorney General Doug Moylan. The request is in response to the public's concerns about the OAG's questionable hiring of Attorney General Moylan's brother Scott Moylan and the hiring and promotion of his fiancée Sheenalyn Hawkins, as well as concerns about the finances and ethics of his office.
Attorney General Moylan claims to be the toughest law enforcer. However, with that responsibility comes the expectation that his office upholds the highest ethical and professional standards, which are called into question by his office's suspicious hiring practices. Attorney General Moylan has diverted substantial resources to investigating and prosecuting so-called "government corruption" cases, all of which have been dismissed, while he openly and brazenly flouts the law.
The Attorney General is not above the law. He should be investigated when his actions raise legal red flags. And if he is found to have committed a crime, he should be prosecuted and punished.
As the chief executive officer of the Government of Guam, charged with ensuring the enforcement of Guam law, Governor Leon Guerrero cannot sit by while the Attorney General engages in conduct that raises legitimate concerns he is violating the law. Because the Attorney General cannot investigate and prosecute his own illegal acts, it falls to the Governor to ensure he is held to account.
"The Attorney General has publicly addressed allegations of impropriety regarding his hiring practices, but his excuses do not pass the smell test," Adelup Director of Communications Krystal Paco-San Agustin stated. "The AG needs to put his money where his mouth is, provide documentation for his questionable hiring and procurements, and give our people the answers they need to judge these transactions for themselves."
