Chapter 13 Hearing Process Changes, Effective February 1, 2025

January 24, 2025

Effective February 1, 2025, the following process changes will be implemented for Chapter 13 hearings.

1. Requests for Continuances of Cases Scheduled for a Chapter 13 Confirmation or Related Hearing
Effective February 1, 2025, the Clerk's Office will no longer accept requests to continue a Chapter 13 Confirmation or Related Hearing via e-mail. Beginning February 1, 2025, all requests for continuance must be filed with the Court via CM/ECF using a new event titled, "Request for Continuance in a Chapter 13 Case."

The use of this event replaces the current practice of using a stipulated letter for continuance. When docketing the new text-only event, the filing party certifies that all interested parties have agreed to the request for a continuance. After the request is docketed, the request will be reviewed and a determination about the request will be docketed in ECF.

2. Proposed Cure Orders
Effective February 1, 2025, the Clerk's Office will no longer accept Proposed Cure Orders via e-mail or via submission to the CM/ECF In-Box. Beginning February 1, 2025, all Proposed Cure Orders must be filed with the Court via CM/ECF using a new event titled, "Proposed Cure Order for a Chapter 13 Case."

3. Discontinue Courtesy E-Mail Communications with the Court
Effective February 1, 2025, please discontinue the practice of copying the judge's Chapter 13 email box on communications between the trustees' offices, attorneys, and other parties.

Please do not email the Court with requests for continuances or any proposed orders. As described above, case participants must file these documents via CM/ECF. Also, do not include the Court on email communications between parties with courtesy comments such as "received," "thank you," or "you are welcome."

Please limit email communications for each judge's Chapter 13 email box(es) to information related to potential docketing errors or urgent matters when you are unable to reach the judge's courtroom deputy by telephone on the morning of the hearing.

4.Schedule Changes for Judge Fisher's Duluth and Twin Cities Chapter 13 Calendars
In April 2025, Judge Fisher's Chapter 13 Hearings will be combined into one hearing date per month. The April 16, 2025 calendar for Division 5 (Duluth) is cancelled. Judge Fisher will hold Chapter 13 Confirmation and Related Hearings for Divisions 3 (St. Paul), 4 (Minneapolis), and 5 (Duluth) on April 24, 2025.

Effective April 1, 2025, Judge Fisher's Chapter 13 email box will change to:
[email protected]

Please see #1-3 above and note that emails sent to this box should be very limited, as Requests for Continuances and Proposed Cure Orders will be filed using CM/ECF. Urgent issues requiring immediate attention should be handled by contacting the Clerk's Office at 651-848-1000 and asking to speak with Judge Fisher's courtroom deputy.

The [email protected] and [email protected] email boxes will be retired on March 31, 2025.

From April 24, 2025, forward, Judge Fisher's Chapter 13 Confirmation and Related Hearings will be scheduled as follows:
10:00 am - Division 3, 4, and 5 Cases - Trustee Carlson's Office
10:30 am - Division 3 and 4 Cases - Trustee Burrell's Office
